Traditional Florida family law concepts and expectations underwent significant changes with the passing of a law made effective October 1, 2008. Previous presumptions regarding child custody that centered on shared parental responsibility coupled with the designation of one of the parents as having primary custody have been greatly modified. The new law eliminates any presumption in favor of one parent over the other, and requires the development of a parenting plan guided by the premise that time shared equally with both parents is in the best interests of children involved in a child custody matter.
In child custody cases, the main focus is rightly on the best interests of the children. It is important to remember, though, that the court's decision can have a serious impact on the parents' ability to have a meaningful relationship with their children.
